As the Parent or Legal Guardian of the above-named applicant:

1. I hereby grant the above-named applicant my consent and approval to participate in the scramble selected above.

2. I will accept responsibility for all rules given by the [specific role, e.g., 'Scramble Chairperson'] prior to the event, which the applicant must fully understand and follow.

3. In case of accident or injury during the contest, I will accept full responsibility for the above-named applicant. The Edgar County Fair and its officials will not be held liable in any way.

I will follow and abide by all instructions expressed by the by the Scramble Chairperson and his/her representatives-both prior to and during the contest. I also hereby agree to all conditions of the release and waiver as listed below.

RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in, officiate, observe, compete in or work for any event, competition or activity, I hereby expressly agree, for myself and on behalf of my personal representatives, assigns, heirs and next-of-kin, to the following:

1. I shall comply with and be bound by each of the rules and regulations of the Edgar County Fair Association (“Fair”).

2. I HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the Fair, any of its officers, directors, members, agents or any promoter, participant, sponsor, advertiser, owner or lessee of any premises associated with the Fair or used to conduct any event or activity of the Fair, all of whom are herein referred to as “releases,” from all liability to me, my personal representatives, assigns, heirs and next-of-kin for any and all loss or damage, any claim or demands for personal injury to me or my property or as a result of my death, whether caused by the negligence of the releasees or otherwise while I am participating in, officiating, observing, competing in or working for any event or activity.

3. I HEREBY AGREE TO INDEMNIFY, SAVE AND HOLD HARMLESS the releases and each of them from any loss, liability, damage or cost they may incur (including attorney’s fees and court costs) because of my involvement or participation in any Fair event, whether caused by the negligence of the releases or otherwise.

4. I expressly understand that the event or activity may be dangerous and involve risk of injury, death or property damage. I HEREBY ASSUME FULL RESPONSIBILITY FOR AND RISK OF BODILY INJURY, DEATH OR PROPERTY DAMAGE while participating or otherwise being involved in any FAIR activity, whether due to the negligence of releases or otherwise.

5. My participation in any fair event or activity shall constitute a conclusive acknowledgement that I have inspected the area where the event or activity is to take place, that I have concluded that it is safe and reasonably suited for my use in participating in the event or activity; further, during my participation, if I feel anything to be unsafe, I will immediately advise the officials and immediately cease participation.

6. I expressly agree that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of Illinois and that if any portion thereof is held invalid, that the balance shall continue in full legal force and effect. I have read and voluntarily signed this agreement. No oral representations, statements or inducements apart from the foregoing agreement have been made to me.
